1. Agreement to Terms

These Terms & Conditions govern your use of the MKB Sound website and all associated services, including beat licensing, sample pack purchases, and audio engineering services. By placing an order or using our site, you acknowledge that you have read, understood, and agree to be bound by these terms.

MKB Sound reserves the right to update these terms at any time. Continued use of our services constitutes acceptance of any modifications.

2. Beat Licensing

All beats available on mkbsound.com are protected by copyright law. Purchasing a license grants you a limited, non-exclusive right to use the beat under the selected license tier. All rights not expressly granted remain with MKB Sound.

License Tiers

• Lease licenses are non-exclusive - the beat may be sold to other artists simultaneously.
• Exclusive licenses grant sole ownership and remove the beat from the store.
• You may not re-sell, sublicense, or transfer any beat license without prior written consent.
• All beats require producer credit: "Prod. by MKB Sound" (waived for Exclusive).
• Licenses are for music and entertainment purposes only; sync licensing for film/TV requires a separate agreement.

3. Sample Packs & Sound Design

All sample packs sold by MKB Sound are 100% royalty-free and cleared for commercial use. Once purchased, you may use the samples in your own musical compositions without additional licensing fees or credits.

• You may NOT resell, redistribute, or re-package sample packs - in whole or in part - as your own product.
• Samples may not be used in adult content, hate speech, or illegal material.
• Using samples in a composition does not transfer copyright of the original sample content.
• Sample packs are delivered digitally - no physical media is shipped.

4. Mixing, Mastering & Production Services

By ordering a mixing, mastering, custom beat, or ghost production service, you agree to the following:

• You represent that you own or have the rights to all audio material you submit to us.
• MKB Sound will not be held liable for content submitted that infringes third-party intellectual property rights.
• You retain full ownership of any files you submit. We do not claim ownership over client-submitted audio.
• Revisions are limited as stated per service tier. Additional revisions may incur extra charges.
• Turnaround times are estimates and may vary depending on project complexity and current workload.
• Final files will be delivered via email or a cloud download link.
• Custom Beat orders are produced according to the agreed creative brief. Rights depend on the selected tier: Starter and Pro are non-exclusive unless otherwise agreed, while Exclusive includes full rights transfer.
• Ghost Production orders are confidential. We do not claim public credit, and rights/file delivery terms are confirmed before production begins.

5. Payment

All prices are listed in EUR (Euros). Payment is processed after order placement:

• We will send a payment link via email within a few hours of receiving your order.
• Work begins only after payment is confirmed.
• We accept PayPal, bank transfer, and major credit/debit cards.
• Prices are subject to change without notice, but changes will not affect confirmed orders.

6. Refund Policy

Due to the digital and custom nature of our products and services, all sales are generally final. Refunds may be considered in the following circumstances:

• A technical error on our part resulted in non-delivery of the purchased product.
• The delivered files are severely different from what was described or agreed upon, and revisions did not resolve the issue.
• A duplicate charge occurred due to a payment processing error.

Refund requests must be submitted within 7 days of delivery to soundsbymkb@gmail.com with a clear explanation. We reserve the right to approve or deny refund requests at our discretion.

7. Intellectual Property

All beats, compositions, sample packs, audio files, artwork, branding, and website content produced by MKB Sound remain the intellectual property of MKB Sound unless explicitly transferred through an Exclusive License. Unauthorized reproduction, distribution, or use of MKB Sound intellectual property without a valid license is strictly prohibited and may result in legal action.

8. Warranties & Representations

MKB Sound warrants that all beats and sample packs are original works created by us and are free from third-party claims at the time of sale. Our services are provided "as is" with the skill and care of professional audio engineers. We do not guarantee specific commercial outcomes or chart performance from our work.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MKB Sound shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount paid for the specific service or product giving rise to the claim.

10. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Lithuania. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Lithuania. If you are located in another jurisdiction, local consumer protection laws may also apply.
